Terms for Gymizen operator software, member booking surfaces, and related services.

These Terms apply to the Gymizen marketing site, free trials, operator console, member-facing experiences, and related services used by gyms, studios, and wellness businesses.

1. Agreement and scope

These Terms of Use govern access to and use of the Gymizen website, trial environment, operator console, member-facing booking experiences, branded portals, and related services made available by Gymizen.

By accessing or using the Services on behalf of a gym, studio, wellness center, or similar organization, you represent that you are authorized to bind that organization to these Terms. If you do not agree to these Terms, do not use the Services.

2. Accounts and access

Customer organizations are responsible for the users they invite into the Services, including owners, managers, staff, and members. Each customer must keep login credentials secure and must promptly notify Gymizen of suspected unauthorized access.

Customers are responsible for assigning appropriate access levels inside the platform and for reviewing whether staff members should have permission to view member information, classes, payments, or concierge recommendations.

3. Trials, subscriptions, and paid use

Gymizen may offer free trials, pilots, or promotional access periods. Trial access may be limited by time, features, locations, staff seats, active members, or other usage thresholds described at signup or in a commercial order form.

Continued use of paid Services may require a subscription or signed commercial agreement. Fees, billing cadence, renewal terms, implementation services, and payment-processing terms are governed by the applicable checkout flow, order form, or written customer agreement.

4. Acceptable use

Customers may use the Services only for lawful business operations related to scheduling, memberships, payments, staff management, communications, and member engagement. Customers may not use the Services to violate privacy rights, spam members, infringe intellectual property, or interfere with the operation of the platform.

Customers may not reverse engineer, copy, resell, frame, or misuse the Services, nor may they attempt to bypass platform limits, security measures, or role-based permissions.

  • No unlawful or deceptive communications.
  • No scraping, probing, or disruptive traffic against the platform.
  • No unauthorized resale or white-labeling without written approval.
  • No uploading of harmful code, malware, or exploit tooling.

5. Customer data and responsibilities

Customers control the business information, staff information, member records, schedules, forms, communications, and other content they submit to Gymizen. Customers are responsible for ensuring they have the right to collect, upload, and use that information inside the Services.

Customers must provide required notices to their staff and members, obtain any legally required consents, and configure the Services in a way that matches their own operational and regulatory obligations.

6. AI and concierge workflows

Gymizen may provide AI-assisted recommendations, issue detection, outreach drafts, playbooks, summaries, and similar concierge features. These outputs are decision-support tools. They may be incomplete, inaccurate, or inappropriate for a specific member or business situation.

Customers remain responsible for reviewing recommendations before acting on them, especially where the action involves outreach, incentives, pricing, operational changes, or sensitive member interactions.

7. Integrations and third-party services

The Services may connect to third-party systems such as payment processors, email providers, accounting tools, video tools, and marketplace platforms. Use of those third-party services may be subject to separate agreements and privacy notices.

Gymizen is not responsible for outages, data handling practices, or feature changes introduced by third-party providers, although Gymizen may suspend or adjust integrations when needed to protect platform stability or customer data.

8. Intellectual property

Gymizen and its licensors retain all rights, title, and interest in the Services, including the software, models, interface design, site content, documentation, and platform-generated materials other than Customer Data.

Customers retain ownership of Customer Data. Customers grant Gymizen the limited rights necessary to host, process, transmit, secure, back up, and display Customer Data for the purpose of providing and improving the Services.

9. Suspension and termination

Gymizen may suspend or restrict access if necessary to address security incidents, abuse, unpaid amounts, material breaches of these Terms, or behavior that creates risk for the platform or other customers.

Either party may terminate use of the Services as permitted by the applicable subscription, order form, or written commercial agreement. Upon termination, access may be removed and Customer Data may be deleted or returned according to the applicable agreement and Gymizen retention policies.

10. Warranties, disclaimers, and liability

Except as expressly stated in a written agreement, the Services are provided on an as-is and as-available basis. Gymizen does not guarantee uninterrupted service, complete accuracy of AI-assisted outputs, or that the Services will be error-free.

To the maximum extent permitted by law, Gymizen disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Gymizen will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or loss of data.

11. Changes to these Terms

Gymizen may update these Terms from time to time. If Gymizen makes a material change, Gymizen may post an updated version on this page, update the effective date, or provide notice through the Services or by email where appropriate.

Continued use of the Services after an update becomes effective means the customer accepts the revised Terms.
